TERMS AND CONDITIONS

These terms and conditions apply to the viewing, purchasing and sale of products through www.packagemore.com (the “site”) as well as phone orders, e-mail orders, and in-person orders. By viewing this site, placing an order, issuing a purchase order, completing a purchase, or making a payment, you acknowledge that you have read, understood, accept, and agree to be bound by these terms and conditions. These terms constitute a binding contract between the Customer and Packaging & More.

Ownership of Materials, Trademarks and Copyright

The information contained in this site including all images, designs, photographs, text and other materials (the “contents”) are copyrights, trademarks, or other intellectual property owned or licensed by Packaging & More or its affiliates, or are the property of their respective owners. The contents of this site may not be copied, republished, downloaded, transmitted, mirrored or reproduced without the prior written permission of Packaging & More or the applicable copyright owner.  Customer represents and warrants that they own or have the legal right to use all trademarks, logos, and artwork provided to Packaging & More for custom production. Customer agrees to indemnify, defend, and hold Packaging & More harmless from any and all claims, suits, or damages arising from the use of such materials.

Limitation of Liability

Packaging & More will not be liable for any indirect, special, incidental, or consequential damages, whether based on contract, tort, or any other legal theory, including without limitation loss of profits, loss of business, or other economic damages. Packaging & More is not responsible for delays in delivery which result from any circumstances beyond its control. Packaging & More’s aggregate liability shall not exceed the purchase price paid for any products purchased through this site, or, if no such products were purchased, ten dollars ($10.00).

Pricing and Specifications

All information regarding pricing, products and services is subject to change. Packaging & More reserves the right to make adjustments to pricing and products for reasons including, but not limited to, changing market conditions, discontinuation, unavailability, manufacturer price changes and errors in advertisements. Unless otherwise specified, all box dimensions listed on this site or provided in quotes refer to the interior (inside) dimensions of the product. Prices listed are net and do not include shipping charges, handling fees, taxes and/or duties or special crating requirements for export shipment. Those customers who claim exemption from taxes or duties are responsible for providing Packaging & More with the necessary documentation at the time of purchase or taxes will be added to their order. Packaging & More strives to maintain prices at the lowest level. Occasionally, prices change without notice due to circumstances beyond our control.

Shipping

Most products are shipped F.O.B. point of origin from the nearest Packaging & More warehouse to your location. Any shipping charges are prepaid by Packaging & More and added to the customer’s invoice unless you choose to be billed freight collect. Any additional charges for services requested by the customer, including but not limited to inside delivery, special routing, residential delivery or pre-delivery notification must be paid by the customer. Customers are responsible for all carrier-imposed accessorial charges, including but not limited to liftgate fees, residential delivery surcharges, re-delivery fees, and storage charges incurred at the destination.

Delivery

The seller will deliver the products to the address specified by the purchaser. Delivery times are estimates only and the seller shall not be liable for any delay in delivery. The risk of loss or damage to the products passes to the purchaser upon delivery. You shall inspect the products upon delivery and shall notify us of any defects or nonconformities within 1 day of delivery. If you fail to give such notice, the merchandise shall be deemed to have been accepted by the purchaser. If a customer fails to accept delivery or provides an invalid delivery address, Packaging & More reserves the right to charge a storage fee for products held in our facilities after 14 business days.

Returns

If for any reason you are dissatisfied with a purchase you made from Packaging & More, you may return the merchandise within 30 days so long as the merchandise is unused, unopened, and in the original condition upon which it was delivered. 30-day money-back guarantee may not apply to custom and made-to-order products. Please contact customer service at customerservice@packagemore.com or at 1-323-277-7500 to request a return merchandise authorization number. Customers will be responsible for any shipping charges on cancelled orders. Due to their nature, custom and made-to-order products cannot be accepted for return unless the product was initially defective. If a product is damaged during delivery to you via a freight carrier, note the damage on the carrier’s delivery receipt and request an inspection report on the damaged shipment from the carrier to be forwarded to you within 10 business days. Forward the inspection report and original packing list to Packaging & More and we will file a claim on your behalf and immediately replace the damaged item(s).

Warranties

Customers acknowledge that Packaging & More is not the manufacturer of any of the products purchased hereunder. Any warranty with respect to the products must come from the manufacturer. Packaging & More will pass through to customers any applicable warranties of the manufacturer to the extent permissible. Notwithstanding anything to the contrary, Packaging & More's liability is limited to the replacement value of the products purchased from this site. Packaging & More and its affiliates hereby expressly disclaim all warranties either express or implied, related to products, including, without limitation, any warranty of merchantability or fitness for a particular purpose, or warranty of noninfringement. This disclaimer does not affect the terms of the manufacturer’s warranty, if any.

Payment Terms

For those customers with established Packaging & More credit, payment terms are generally net 30 days from the date of invoice. In addition, Packaging & More accepts all major credit cards, ACH, Wire, or check at the time of order. C.O.D. is also available.

Custom and Made-to-Order Products

For all custom-produced or made-to-order products, Packaging & More reserves the right to require a deposit, or full pre-payment prior to the commencement of production.  Production will not begin until such payment is received and cleared. As is industry standard, custom products are subject to a final quantity variance of +/-10%.

• Over-runs: In the event of an over-run (where the final quantity produced exceeds the ordered quantity), the customer will be invoiced for the additional units at the same unit price as the original order. These additional charges will be billed on the final invoice and are due according to the customer's established payment terms. 
• Under-runs: In the event of an under-run, the customer will only be charged for the actual quantity delivered.  Any overpayment resulting from an under-run will be applied as a credit to the customer’s account or, upon the customer's request, refunded to the customer.
• Proof Approval: Production will not begin until a final digital or physical proof is approved in writing by the customer. Packaging & More is not responsible for errors in the finished product that were present in the approved proof, including but not limited to spelling, typos, color matching, and layout.

Applicable Law

This site is controlled by us from our offices within the State of California, United States of America. By accessing this site you agree that the laws of the State of California, without regard to conflicts of laws principles, will apply to all matters relating to the use of this site and the purchase of products available through this site. Any litigation will be brought exclusively in Los Angeles County, California and customer consents to the jurisdiction of the Federal and State Courts located therein, submits to the jurisdiction thereof and waives the right to change venue.

Entire Agreement

These terms and conditions constitute the entire agreement and understanding between you, the customer, and Packaging & More concerning the subject matter hereof and supersedes all prior agreements and understandings of the parties with respect thereto, including any oral statements made by Packaging & More representatives or any alternate terms supplied by you to Packaging & More unless otherwise agreed to by Packaging & More in writing. To the extent that anything in or associated with site is in conflict or inconsistent with these terms and conditions, these terms and conditions shall take precedence.

Amendments

Packaging & More reserves the right to amend these terms and conditions at any time by posting the amended terms and conditions on the site. Your continued business with Packaging & More following the posting of the amended terms and conditions shall constitute acceptance of the amended terms and conditions.
